LMIA and LMIA work permit (Temporary Foreign Worker Program)
The LMIA program was set up by the government to fill labour shortage in the Canadian Labour Market by allowing employers to hire Foreign Workers by getting a Positive LMIA decision from Employment and Social Development Canada (ESDC). The LMIA based work permit is a closed work permit which means that the worker will be able to work for Only the employer who extended a positive LMIA support to him/her
LMIA based work permit is a two-step application process. The first step is to apply for an LMIA to Service Canada to get a Positive LMIA decision. The ESDC will assess the effects of hiring a foreign national on the Canadian labour market and once they approve the hiring, a positive decision is issued to the employer.
Once the decision is received, the second step is to apply for a work permit once an employer has obtained a positive LMIA from Service Canada. Work permit application is submitted to Immigration, Refugees and Citizenship Canada (IRCC).
